Because Mood Voyagers Bipolar provides mental-health education and support resources, some information users choose to enter into the App may constitute sensitive health or mental-health information. We recognize the particularly sensitive nature of this information and are committed to handling it responsibly.

We do not provide identifiable health or mental-health information to data brokers for marketing purposes.

We do not permit third parties to use identifiable health or mental-health information obtained through Mood Voyagers Bipolar to independently market products or services to users.

5. WHEN INFORMATION MAY BE SHARED

We do not disclose personal information except as described in this Privacy Policy or as otherwise disclosed to and authorized by the user.

Service Providers

We may use carefully selected service providers to perform functions necessary to operate the App, such as:

  • cloud hosting;

  • data storage;

  • authentication;

  • security;

  • error and crash monitoring;

  • customer support; and

  • technical infrastructure.

These providers may receive information only as reasonably necessary to perform services for us. We require service providers that receive personal information to protect that information appropriately and to process it only for authorized purposes, subject to applicable contractual and legal requirements.

Sharing Directed by the User

We may disclose information when a user specifically requests, directs, or authorizes us to do so.

For example, if a future App feature allows a user to share information with a family member, ally, therapist, physician, or another person, information will be shared according to the user's direction and the functionality disclosed to the user.

Users should carefully consider the information they choose to share with another person.

Legal Requirements and Protection of Rights

We may disclose information when reasonably necessary to comply with applicable law, regulation, court order, subpoena, or another legally enforceable governmental request.

We may also disclose information when permitted by law and reasonably necessary to investigate fraud, security threats, or misuse of the App or to protect the rights or safety of DM Endeavors, LLC, our users, or others.

6. CRISIS AND SAFETY INFORMATION

Mood Voyagers Bipolar is not continuously monitored by mental-health professionals and should not be used to communicate an emergency or request immediate clinical assistance.

Information entered into the App should not be assumed to be reviewed in real time by a therapist, physician, crisis counselor, or other healthcare professional.

If a user enters information concerning suicidal thoughts, self-harm, violence, mania, psychosis, or another serious mental-health concern, the user should not assume that Mood Voyagers Bipolar will detect that information, contact another person, or initiate an emergency response.

Users experiencing an emergency or who believe they may be unable to remain safe should immediately contact 911, local emergency services, or an appropriate crisis resource.

7. HIPAA AND OTHER HEALTH-PRIVACY LAWS

Mood Voyagers Bipolar is a consumer mental-health education and support application.

The Health Insurance Portability and Accountability Act (“HIPAA”) does not automatically apply to information simply because that information concerns an individual's health. HIPAA generally applies to certain healthcare providers, health plans, healthcare clearinghouses, and their qualifying business associates.

Unless specifically stated otherwise in connection with a particular service, users should not assume that information entered into Mood Voyagers Bipolar is protected by HIPAA.

Other federal or state privacy laws may nevertheless protect health information maintained by the App.

Regardless of whether HIPAA applies, we recognize the sensitive nature of mental-health information and use privacy and security safeguards designed to protect personal information entrusted to us.

8. DATA SECURITY

We use reasonable administrative, technical, and organizational safeguards designed to protect personal information from unauthorized access, acquisition, use, alteration, disclosure, or destruction.

Our safeguards may include, as appropriate:

  • access controls;

  • authentication measures;

  • secure software-development practices;

  • security monitoring and logging;

  • safeguards for information transmitted or stored by the App; and

  • limiting access to personal information to persons who require access for legitimate operational purposes.

No electronic information system can be guaranteed to be completely secure. Users should therefore take reasonable precautions to protect their devices, passwords, and accounts.

9. DATA BREACHES AND UNAUTHORIZED DISCLOSURES

If we discover a breach or unauthorized disclosure involving personal or health information, we will investigate the incident and provide notifications to affected individuals, government agencies, or others when required by applicable law.

Applicable requirements may include federal or state health-data breach notification laws.

10. DATA RETENTION

We retain personal information for as long as reasonably necessary to provide the App, fulfill the purposes described in this Privacy Policy, meet legitimate operational and security needs, and comply with applicable legal requirements.

Unless a shorter retention period is required by law or a user's valid deletion request requires earlier deletion, certain user account and health or wellness information may be retained for up to one year following discontinuation of the user's use of the App.

When information is no longer reasonably necessary or retention is no longer permitted, we will delete, de-identify, or securely dispose of it as appropriate.

Information contained in routine backup or disaster-recovery systems may remain for a limited period until the backup is deleted or overwritten in the ordinary course of operations.

11. ACCESS, CORRECTION, AND DELETION

Depending upon applicable law and App functionality, users may have rights to:

  • access personal information we maintain about them;

  • correct inaccurate personal information;

  • request deletion of personal information;

  • withdraw certain permissions or consent;

  • request deletion of an account;

  • obtain information concerning how personal information is collected, used, or disclosed; and

  • exercise additional privacy rights provided by applicable law.

Users may submit an account or data deletion request by contacting: moodvoyagers@gmail.com

We may take reasonable steps to verify a person's identity before fulfilling a privacy request.

Certain information may be retained when required or permitted by law, including where reasonably necessary for security, fraud prevention, legal compliance, or establishment or defense of legal claims.

We will not unlawfully discriminate against a user for exercising applicable privacy rights.

12. DEVICE PERMISSIONS

Some App features may require access to device functions or information.

Depending upon the features a user chooses to use, Mood Voyagers Bipolar may request access to:

  • notifications;

  • camera;

  • microphone; and

  • photos or media.

The App will request permission before accessing these functions when required by the device operating system or applicable law.

Users can generally modify permissions through their device settings. Disabling a permission may prevent the associated App feature from functioning.

13. NOTIFICATIONS

If users enable push notifications, Mood Voyagers Bipolar may send reminders, educational messages, or other App-related communications.

Because notifications may appear on a device's lock screen, users should consider their personal privacy when enabling notifications relating to mental health or App activity.

Notification settings can generally be changed through the App or device settings.

14. CHILDREN AND MINORS

Mood Voyagers Bipolar is intended for individuals 18 years of age and older.

We do not knowingly collect personal information from children under 18 through the App.

If we learn that we have collected personal information from a person under 18 contrary to this policy, we will take appropriate steps to delete the information.

A parent or guardian who believes a person under 18 has provided personal information through the App may contact us at: moodvoyagers@gmail.com

15. THIRD-PARTY LINKS AND RESOURCES

Mood Voyagers Bipolar may provide links to educational resources, crisis resources, healthcare information, or third-party websites and services.

DM Endeavors, LLC does not control the privacy or security practices of independent third parties. Users should review the privacy policies of those services before providing personal information.

16. UNITED STATES USERS

Mood Voyagers Bipolar is currently intended primarily for users in the United States.

Personal information may be processed or stored in the United States or in other locations where our service providers operate, subject to applicable law.

Residents of certain states may have additional privacy rights concerning personal information or consumer health data. Where applicable, we will honor those rights as required by law.

Expansion into additional countries or jurisdictions may require additional privacy notices, consent mechanisms, or other protections.

17. CHANGES TO THIS PRIVACY POLICY

We may update this Privacy Policy as Mood Voyagers Bipolar evolves, our information practices change, or applicable legal requirements change.

When changes are made, we will update the “Last Updated” date above and provide additional notice when required by law.

If a change materially affects how previously collected sensitive health information will be used or disclosed, we will obtain consent when required by applicable law.
